PRICING AND PAYMENT
I acknowledge and agree that this Personal Training Contract is not transferable or assignable. I acknowledge that payment is required for blocks of sessions in advance of actual training sessions. I agree to pay in advance for training sessions. I understand this money is not refundable. I understand this contract and the terms it presents is for the purchase of sessions and any other purchase of services in the future.
I acknowledge that this specific contract, release of liability, consent, and agreement is continuously valid indefinitely. I understand that a minimum requirement of one session per week must be completed or I will be charged for the session(s) missed. No refund will be granted for sessions that have not been completed.
I understand Elite Technique LLC has the right and the authority to terminate the program at any time, with no refund, if I do not follow the program or fail to conduct myself in an appropriate manner.
By making this payment, I attest, contract, acknowledge, and agree that I am legally bound by its content.
Terms and Conditions
RELEASE OF LIABILITY (Please Read Carefully)
I have enrolled in a program of strenuous physical activity including, but not limited to walking, running, boxing, yoga, aqua aerobics, massage therapy, weight lifting, bicycling, in-line skating and the use of various conditioning and exercise equipment and facilities designed, offered, recommended, and/or supervised by Elite Technique LLC. I hereby affirm that I am in good physical condition and do not suffer from any disability that would prevent or limit my participation in this program.
In consideration of my participation in the program, I for myself, my employees, heirs, assigns, agents, officers, directors, shareholders and co-workers hereby release Elite Technique LLC, its employees, heirs, assigns, agents, officers, directors, and shareholders, from any and all claims, demands or causes of action arising from my participation in the program or from any use of the conditioning and exercise equipment and facilities.
I fully understand that I may suffer injury as a result of my participation in the program and I hereby release Elite Technique LLC from any and all liability now or in the future, including but not limited to medical expenses, lost wages, pain and suffering, that may occur by reason of heart attacks, muscle strains, pulls or tears, broken bones, shin splints, heat prostration, knee/lower back/foot injuries, and any other illness, soreness, or injury, however caused, whether occurring during or after my participation in the program or use of the conditioning and exercise equipment and facilities, regardless of fault.
By Signing this document, I attest, contract, acknowledge, and agree that I am legally bound by its content.
CANCELLATION AND LATENESS
I acknowledge that appointment times are reserved and that cancellations must be made 24 hours in advance. Cancellations must be made by calling/texting my trainer or the company at 240-583-0303 (voicemail will record date/time). It is my responsibility to reschedule missed or cancelled appointments within the 30 day duration of my package. I understand that I will not receive a refund for missed or cancelled appointments.
It is my responsibility to attend my personal training appointments when they are scheduled. I understand that I am able to extended my package due to travel or medical reasons when proof or documentation is provided.
I understand that appointments will begin and end promptly as scheduled. I acknowledge that any delays to the start of a scheduled appointment will not be a cause of extend provided service beyond the remainder of the scheduled time. I will not expect or ask my trainer to run overtime. I understand that if I am 15 minutes late my session will be canceled and I will be charged for that session. I understand that sessions will run approximately 30 minutes unless otherwise stated.
I acknowledge that a delay to a scheduled session cannot change the session status to anything else except a whole session. I understand that there are no half sessions because of any delay.
MEDIA, RECORDING, AND DOCUMENTATION CONSENT
I understand and agree that Elite Technique LLC may, from time to time, capture photos, videos, or audio recordings during training sessions for internal purposes only, including but not limited to:
Staff training and development
Quality control and performance review
Client progress documentation and insurance compliance
I acknowledge that these recordings are the property of Elite Technique LLC and will be stored securely. I consent to the use and retention of my images, likeness, or recordings strictly for internal business and documentation purposes.
I understand that no photo, video, or recording of me will be shared publicly, posted on social media, or used for marketing without my separate, written consent.
This consent remains valid for the duration of my participation in the program and thereafter for documentation and record-keeping purposes, unless otherwise revoked in writing for future recordings only.
By signing this agreement or submitting payment, I acknowledge that I have read, understood, and agree to this Media, Recording, and Documentation Consent.
Disclaimer
In light of the current COVID-19 Pandemic and the evolving conditions of the pandemic due to the various virus variants (delta strain) - Elite always recommend clients get tested according to CDC guidelines if they feel, suspect or believe that they have been exposed to COVID-19 in any environment including while training. Due to legal constraints we can not disclose any healthcare status of clients or trainers including COVID-19 Status.
If you are concerned about COVID-19 exposure- We strongly recommended you get tested at your earliest convenience per CDC guidelines.

In light of the COVID-19 pandemic, I recognize that I am taking a risk by electing to participate in a personal training environment that involves contact with personal trainers as well as other patrons of this personal training program I I will always get tested if I suspect or have any symptoms of COVID-19 and seek medical treatment per CDC guidelines.
By making this payment, I attest, contract, acknowledge, and agree that I am legally bound by its content.
