Terms and Conditions for Elite Technique LLC

These Terms and Conditions govern your access to and use of Elite-Technique.com, your purchase of products from Elite Technique LLC, and your participation in communications and text-messaging programs offered by Elite Technique LLC.

In these Terms and Conditions, “Elite Technique,” “we,” “us,” and “our” refer to Elite Technique LLC. “You” and “your” refer to the person accessing our website, purchasing our products, using our services, or enrolling in our communications programs.

By accessing our website, purchasing a product, submitting a form, creating an account, or otherwise using our website, you agree to these Terms and Conditions. If you do not agree with these Terms and Conditions, you should not use our website or purchase products through it.

Consent to receive marketing text messages is optional and is not required to access our website, create an account, purchase a product, or purchase personal training services.

1. Website Use

You may use Elite-Technique.com only for lawful purposes and in accordance with these Terms and Conditions.

You agree not to:

  • Use the website in violation of any applicable law or regulation.
  • Attempt to gain unauthorized access to the website, its servers, accounts, systems, or networks.
  • Interfere with the security, availability, or operation of the website.
  • Introduce viruses, malicious code, or other harmful technology.
  • Use automated tools to scrape, copy, or extract website content without written authorization.
  • Impersonate another individual or misrepresent your identity or affiliation.
  • Use the website to engage in fraud, harassment, abuse, or other unlawful conduct.

We may suspend or terminate access to the website when we reasonably believe these Terms and Conditions have been violated.

2. Eligibility

You must be at least 18 years old to make purchases, enter agreements, or independently enroll in an Elite Technique communications program.

A parent or legal guardian must complete applicable agreements and provide consent for a participant who is under 18 years old.

3. Intellectual Property Rights

The content displayed or made available through Elite-Technique.com—including our business name, logos, trademarks, text, graphics, photographs, videos, designs, software, downloadable materials, and other content—is owned by or licensed to Elite Technique LLC and is protected by applicable copyright, trademark, and intellectual-property laws.

You may not copy, reproduce, republish, distribute, modify, display, sell, license, transmit, or commercially exploit our content without prior written permission from Elite Technique LLC.

Limited personal, noncommercial use of the website does not transfer any ownership or intellectual-property rights to you.

4. Products and Purchasing

Products offered through the website may include apparel, merchandise, supplements, accessories, and other goods.

All products are subject to availability. We may:

  • Change or discontinue products without notice.
  • Limit the quantities available for purchase.
  • Limit or cancel orders placed by the same person, household, account, payment method, or address.
  • Refuse or cancel an order when we reasonably suspect fraud, unauthorized activity, pricing errors, resale activity, or a violation of these Terms and Conditions.

Prices, product descriptions, promotions, availability, and other information may change without notice.

We attempt to display product descriptions, images, and prices accurately. However, we do not guarantee that all website information will always be complete, current, or error-free. If a material error affects your order, we may cancel the order and refund the amount paid.

5. Payment

You agree to provide current, accurate, and complete billing and payment information.

You authorize Elite Technique and its payment processors to charge the payment method provided for your purchase, including applicable taxes, shipping charges, and other disclosed fees.

Payment-card transactions may be processed by third-party payment processors. Their processing of payment information may be governed by their own terms and privacy policies.

6. Shipping and Delivery

Shipping and delivery dates are estimates unless expressly guaranteed in writing.

Elite Technique is not responsible for delays caused by carriers, weather, incorrect addresses, supply interruptions, or other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address.

7. Returns and Refunds

Elite Technique LLC offers a seven-day return period for eligible products.

To be eligible for consideration, the product must be returned within seven calendar days after receipt and must satisfy the following conditions:

  • Apparel and merchandise must be unworn, unwashed, unused, and returned in their original condition with all original tags attached.
  • Supplements, food products, and other consumable items must be unopened, unused, and returned with the original seal intact.
  • Proof of purchase is required.
  • The customer is responsible for return-shipping costs unless the return results from a defective product, an incorrect item, or another confirmed error by Elite Technique.

Certain products may be final sale or ineligible for return because of hygiene, health, safety, personalization, clearance status, or other stated reasons. Any applicable exception should be identified on the product page or during checkout.

We may provide a Return Authorization number and return instructions. Returns submitted without authorization may be delayed or refused.

Approved refunds will be returned to the original payment method, generally within five to seven business days after the returned item has been received, inspected, and approved. Your bank or payment provider may require additional processing time.

Original shipping charges are nonrefundable unless the return resulted from our confirmed error.

8. Supplements and Health-Related Products

Information about supplements, fitness products, nutrition, exercise, or wellness is provided for general informational purposes and is not medical advice.

Statements concerning supplements or other products may not have been evaluated by the U.S. Food and Drug Administration. Products are not intended to diagnose, treat, cure, or prevent a disease unless expressly authorized by applicable law.

Consult an appropriately qualified healthcare professional before beginning a supplement, diet, fitness, or wellness program, particularly if you:

  • Have a medical condition.
  • Take prescription or over-the-counter medications.
  • Are pregnant or nursing.
  • Have allergies or sensitivities.
  • Are purchasing a product for a minor.

You are responsible for reviewing product ingredients, warnings, directions, and expiration information before use.

9. Personal Training Services

Purchases of personal training services may be governed by a separate Personal Training Contract, Release of Liability, cancellation policy, payment authorization, or membership agreement.

When a separate agreement applies, that separate agreement controls the specific personal training services covered by it. These website Terms and Conditions do not replace the Personal Training Contract or Release of Liability.

10. Elite Technique Text-Messaging Programs

Elite Technique may offer recurring SMS and MMS text-message programs.

Our text-messaging programs may include:

Feedback and Service Communications

Messages may concern:

  • Client feedback requests.
  • Client-experience surveys.
  • Training milestone surveys.
  • Appointment and scheduling communications.
  • Account or package information.
  • Payment-related service notices.
  • Trainer or location updates.
  • Service changes.
  • Customer-support communications.
  • Other non-promotional communications concerning services requested or received.

Marketing and Promotional Communications

Messages may concern:

  • Personal training promotions.
  • Discounts and limited-time offers.
  • Reactivation offers for former clients.
  • Training-package promotions.
  • New services.
  • New or existing locations.
  • Events.
  • Company announcements.
  • Other Elite Technique marketing or advertising.

11. SMS Enrollment and Consent

You may enroll in an Elite Technique text-messaging program by entering your mobile number and affirmatively selecting the applicable SMS consent checkbox on an Elite Technique or Mindbody form, or through another clearly disclosed enrollment method.

SMS consent controls should be optional and unchecked by default.

By affirmatively enrolling, you authorize Elite Technique LLC to send recurring SMS or MMS messages to the mobile number you provide. Messages may be sent through automated technology.

You represent that:

  • You are the subscriber or customary user of the number provided.
  • You are authorized to consent to text messages at that number.
  • The number is accurate.
  • You will notify Elite Technique or unsubscribe if you stop using or controlling the number.

Your consent applies only to messages from or on behalf of Elite Technique LLC.

Consent to receive marketing or promotional text messages is not a condition of purchasing any property, goods, or services.

Consent to receive one category of communication does not necessarily constitute consent to receive every category. Elite Technique may provide separate enrollment options for feedback and service messages and for marketing and promotional messages.

12. SMS Message Frequency

Message frequency varies based on:

  • Your account and training activity.
  • Scheduled appointments.
  • Feedback and survey milestones.
  • Customer-service interactions.
  • The promotions or announcements offered by Elite Technique.

You may receive multiple messages in a month. Unless a specific enrollment disclosure provides otherwise, Elite Technique does not guarantee a minimum or maximum number of messages.

13. SMS Charges

Message and data rates may apply.

Elite Technique does not generally charge a separate participation fee for its text-messaging programs. However, your mobile carrier’s standard messaging, data, roaming, or other charges may apply.

You are responsible for charges imposed by your wireless provider.

14. SMS Opt-Out Instructions

You may withdraw your consent and unsubscribe from recurring text messages at any time by replying:

STOP

Elite Technique may also recognize other customary opt-out requests, including CANCEL, END, QUIT, UNSUBSCRIBE, or another clear statement that you no longer wish to receive messages.

After opting out, you may receive one final non-promotional message confirming that your request has been processed.

When multiple communication categories are sent from the same telephone number, replying STOP may stop all recurring messages sent from that number.

You may enroll again later by completing a new consent process offered by Elite Technique.

16. SMS Delivery and Supported Carriers

Text-message delivery is subject to your wireless carrier’s network, device compatibility, service availability, and other circumstances outside Elite Technique’s control.

Elite Technique, its messaging providers, and participating mobile carriers do not guarantee that every message will be delivered, delivered without interruption, or delivered by a particular time.

Mobile carriers are not liable for delayed or undelivered messages.

17. SMS Privacy

Elite Technique handles personal information collected through its text-messaging programs according to our Privacy Policy:

Elite Technique does not sell, rent, or share mobile telephone numbers, SMS opt-in information, or text-messaging consent information with third parties or affiliates for their own marketing or promotional purposes.

We may provide limited information to vendors that perform services for Elite Technique, including Mindbody, communications providers, telecommunications carriers, hosting services, and customer-management providers. Those providers may process information only as necessary to perform services for Elite Technique and may not use mobile opt-in information for their own independent marketing.

SMS consent is specific to Elite Technique and is not transferable to another unrelated business.

Elite Technique may retain records documenting:

  • The mobile number provided.
  • The date and time consent was given.
  • The consent language presented.
  • The checkbox or communication category selected.
  • The form, page, or method through which consent was provided.
  • The source or version of the applicable disclosure.

The presence of a link does not necessarily constitute an endorsement.

21. User Submissions and Feedback

When you voluntarily submit a review, testimonial, comment, survey response, photograph, or other material, you represent that:

  • The information is accurate to the best of your knowledge.
  • You have the right to submit it.
  • It does not violate another person’s rights.

Elite Technique will not publicly use your name, image, testimonial, or identifiable training results for advertising unless it has an appropriate legal basis or permission to do so.

Any separate Personal Training Contract or other agreement may contain additional dispute-resolution or venue provisions.

28. Severability

If a provision of these Terms and Conditions is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

29. No Waiver

A failure by Elite Technique to enforce a provision of these Terms and Conditions does not waive our right to enforce that provision later.

30. Entire Agreement

These Terms and Conditions, together with the Privacy Policy and any applicable purchase, training, membership, payment, or service agreement, constitute the agreement governing the applicable website use or transaction.

If a separate signed agreement conflicts with these general Terms and Conditions regarding a specific service, the separate signed agreement controls that specific service.
